Litigation
Successfully argued Bank of Montreal v. Korico et.al 50 OR (3rd) 520 (September 8, 2000). Court of Appeal decision with respect to the immediate enforcebility of guarantees in the face of common law defense. Bank was denied leave to appeal to the Supreme Court of Canada. Canadian Bankers Association has been denied it's Motion for Intervention.
Real Estate Disputes - Breaches of Warranties - Terms & Conditions - Agent & Broker Liabilities on Listing Agreements and Agreements of Purchase & Sales - Partition & Sales Proceedings - Mortgage Enforcement and Priority Disputes between Execution Creditors - Fraudulent or Preferred Assignees; second, third and fourth Mortgages - Other encumbrancers on Tittle.
